Terms and Conditions for Bayani Hearth

Welcome to Bayani Hearth. These Terms and Conditions ("Terms") govern your access to and use of our online platform, including all online cooking courses, live interactive cooking classes, Filipino cuisine workshops, recipe development tutorials, and culinary skills certification programs (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

1. Acceptance of Terms

By creating an account, accessing our site, enrolling in any course, or using any part of our online platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legal agreement between you and Bayani Hearth.

2. Eligibility and Account

To access certain features of our Services, you may be required to register for an account. You must be at least 18 years old to create an account and use our paid Services. If you are under 18, you may use our Services only with the involvement of a parent or guardian. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account. Bayani Hearth cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

3. Our Services

Bayani Hearth provides online education in culinary arts, specializing in Filipino cuisine. Our Services include:

• Online cooking courses
• Live interactive cooking classes
• Filipino cuisine workshops
• Recipe development tutorials
• Culinary skills certification programs

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

4. Payments and Refunds

All fees for our Services are specified on our site. You agree to pay all applicable fees as they become due. Payments are processed through third-party payment processors. Bayani Hearth does not store your credit card information.

Refund Policy:

• For online courses, a full refund may be issued if requested within 7 days of purchase AND if less than 10% of the course content has been accessed.
• For live interactive classes and workshops, refunds are subject to the specific cancellation policy stated at the time of booking. Generally, no refunds will be issued for cancellations made less than 48 hours before the scheduled class.
• Certification program fees are generally non-refundable once the program has commenced.
• All refunds, if applicable, will be processed back to the original method of payment within a reasonable timeframe.

5. Intellectual Property

All content on Bayani Hearth, including but not limited to text, graphics, images, videos, recipes, course materials, logos, and software, is the property of Bayani Hearth or its licensors and is protected by intellectual property laws.

• You are granted a limited, non-exclusive, non-transferable license to access and use the content for your personal, non-commercial educational purposes, strictly in accordance with these Terms.
• You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any content without the express written permission of Bayani Hearth.
• Any unauthorized use of our content may violate copyright, trademark, and other laws and could result in legal penalties.

6. User Conduct

You agree not to use our Services to:

• Engage in any activity that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

7. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

• Bayani Hearth does not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
• We make no warranty regarding the accuracy, completeness, or reliability of any content obtained through our Services.
• You assume all risk for any damage to your computer system or loss of data that results from accessing or using our Services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BAYANI HEARTH, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

9. Indemnification

You agree to indemnify and hold harmless Bayani Hearth, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts located in Quezon City, Metro Manila, Philippines.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
